By accessing or using any website, platform, software, portal, communication channel, or service provided by MassMonopoly Media Productions, Inc. (“MassMonopoly,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use our services.

1. Scope of Services

MassMonopoly provides a combination of professional services and technology-enabled solutions, which may include, but are not limited to:

  • Digital marketing strategy, consulting, and execution
  • Website design, development, hosting, and maintenance
  • Search engine optimization (SEO), content, and analytics
  • Paid media and advertising support
  • AI-assisted marketing consulting and workflows
  • Marketing automation, CRM, and software access via the MassMonopoly Growth Hub
  • SMS, email, call tracking, chat, AI agents, and related communication tools
  • Client portals, dashboards, and reporting tools

Services may be delivered as one-time projects, recurring subscriptions, retainers, or usage-based access, as defined in a proposal, order form, invoice, or written agreement.

2. Accounts, Registration, and Security

Certain services require account creation. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the confidentiality of your login credentials
  • Accept responsibility for all activity under your account

MassMonopoly may suspend or terminate access if account security is compromised or these Terms are violated.

3. Payments, Subscriptions, and Billing

  • All fees are billed in U.S. dollars unless otherwise stated.
  • Payments are due upon receipt or within the timeframe specified on your invoice or agreement.
  • Subscription services may renew automatically unless canceled in writing per the applicable terms.
  • Failed or overdue payments may result in suspension or termination of services.
  • Refunds are not provided, unless explicitly stated in writing.

You are responsible for all applicable taxes, third-party platform fees, advertising spend, carrier charges, and usage-based costs.

4. Acceptable Use & Legal Compliance

You agree not to use MassMonopoly services for:

  • Spam, unsolicited messaging, or deceptive practices
  • Violations of CAN-SPAM, TCPA, GDPR, CCPA, or similar regulations
  • Illegal, abusive, infringing, or misleading activities
  • Circumventing safeguards, platform rules, or carrier policies

You are solely responsible for obtaining proper consent for SMS, email, voice, and automated communications.

You agree to indemnify and hold MassMonopoly harmless from any claims, fines, penalties, or damages arising from misuse or non-compliance.

MassMonopoly reserves the right to immediately suspend services for violations.

5. Software & SaaS Services (Growth Hub)

MassMonopoly’s software-enabled offerings, including the Growth Hub, CRM access, automation tools, AI agents, messaging systems, and portals
(“Software Services”), are provided under a non-exclusive, non-transferable, revocable license.

  • No ownership rights are transferred.
  • Access is limited to the duration of an active subscription or agreement.
  • Services are provided on an “as-available” basis, with no guarantee of uptime or uninterrupted access.

Planned maintenance, third-party outages, carrier issues, or platform changes may affect availability.

6. Client Responsibility for Configuration & Results

You are responsible for:

  • Data accuracy entered into systems
  • Campaign setup, messaging content, and automation logic
  • Monitoring outputs and performance
  • Ensuring legal and platform compliance

MassMonopoly does not guarantee leads, conversions, revenue, deliverability, rankings, or business outcomes.

7. Third-Party Platforms & Dependencies

Our services may rely on third-party platforms and providers (including but not limited to GoHighLevel, Twilio, Google, Meta, email and SMS carriers).

MassMonopoly is not responsible for:

  • Outages or service interruptions
  • Policy or pricing changes
  • Account suspensions or carrier blocks
  • Data loss caused by third parties

Use of such platforms is subject to their respective terms.

8. AI-Assisted Services Disclaimer

AI-powered tools and recommendations are provided for assistive purposes only.

  • Outputs may be inaccurate, incomplete, or non-compliant
  • Human review is required before implementation
  • No guarantees are made regarding outcomes or performance

You remain fully responsible for decisions made using AI-generated outputs.

9. Intellectual Property

Unless otherwise agreed in writing:

  • All methodologies, workflows, templates, software configurations, and proprietary materials remain the intellectual property of MassMonopoly.
  • Client-provided content remains the property of the client.
  • No ownership transfer occurs without explicit written agreement.

10. Suspension & Termination

MassMonopoly may suspend or terminate services at its discretion for:

  • Non-payment
  • Violations of these Terms
  • Legal or compliance risk
  • Misuse of platforms or services

Upon termination, access to systems, software, and data may be revoked.

11. Limitation of Liability

To the fullest extent permitted by law:

  • MassMonopoly shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost revenue, lost data, or advertising losses.
  • Total liability shall not exceed the fees paid to MassMonopoly in the 90 days preceding the claim.

All services are provided “as-is” and “as available,” without warranties of any kind.

12. Indemnification

You agree to indemnify, defend, and hold harmless MassMonopoly from any claims, damages, liabilities, costs, or legal fees arising from your use of our services,
content, data practices, or communications.

13. Governing Law & Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts. All disputes shall be resolved exclusively in state or federal courts located in Massachusetts.

14. Changes to These Terms

MassMonopoly may update these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.
